Privacy Policy

1. Who we are

Primary Maintenance Contracts (Pty) Ltd, trading as PMC (“PMC”, “we”, “us”, “our”), is a South African property maintenance and contracting company. This policy explains how we process personal information in accordance with the Protection of Personal Information Act, 4 of 2013 (“POPIA”).

2. The information we collect

We only collect information that is necessary to quote on, deliver and stand behind our work. Typically this includes:

  • Identifying details: name, email address, contact number.
  • Property details: physical address, suburb, photographs and a description of the work required.
  • Communication records: enquiry messages, quotes, invoices and correspondence.
  • Payment information for invoicing (we do not store card data).
  • Technical information when you visit this website: IP address, browser type, pages viewed and approximate location.

3. Why we process your information

We process personal information for the following lawful purposes (s.11 POPIA):

  • To respond to enquiries and prepare quotations.
  • To perform contracts for maintenance and contracting services.
  • To comply with legal, tax, accounting and regulatory obligations.
  • To protect our legitimate interests (e.g. invoicing, dispute resolution, fraud prevention).
  • With your consent, to send occasional service updates or marketing — which you may opt out of at any time.

4. How we share information

We do not sell personal information. We may share it with:

  • Vetted subcontractors and suppliers strictly to deliver your project.
  • Our accountants, auditors and legal advisors.
  • Cloud and IT service providers hosting our systems (under written safeguards).
  • SARS, courts or regulators where required by law.

Where personal information is transferred outside South Africa (for example, to international cloud providers), we ensure the recipient is bound by laws or binding contracts offering protection substantially similar to POPIA (s.72).

5. How we protect your information

We apply reasonable technical and organisational safeguards — access controls, encryption in transit, vetted suppliers, staff confidentiality and secure disposal — to prevent loss, damage or unauthorised access (s.19 POPIA). In the event of a compromise, we will notify the Information Regulator and affected data subjects as required (s.22).

6. How long we keep your information

We retain personal information only for as long as it is needed for the purpose collected, or as required by law (for example, tax records for at least five years under the Tax Administration Act). Project records are typically kept for the duration of any workmanship guarantee plus seven years.

7. Your rights

Under POPIA you have the right to:

  • Be notified that we hold your information and what we do with it.
  • Request access to, correction or deletion of your information (s.23–24).
  • Object to processing or withdraw consent at any time (s.11(3)).
  • Lodge a complaint with the Information Regulator.

8. Cookies

9. Children

Our services are intended for adults. We do not knowingly collect personal information of children under 18 without parental or guardian consent.
