1. About these terms

These terms govern your use of the website operated by Primary Maintenance Contracts (Pty) Ltd (“PMC“, “we”, “us”), and the supply of any maintenance, waterproofing, damp-proofing, painting or contracting services we provide. They are issued in accordance with the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”) and the Consumer Protection Act 68 of 2008 (“CPA”), where applicable.

By using this website or accepting a written quotation from us, you agree to these terms.

3. Quotations and acceptance

  • Quotations are based on the scope discussed and the site conditions visible at the time of inspection.
  • Unless stated otherwise, quotes are valid for 30 days from the date of issue.
  • A signed quotation, written acceptance by email, or payment of a deposit constitutes acceptance and forms a binding agreement.
  • Verbal instructions to vary scope must be confirmed in writing; cost or timeline adjustments may apply.

4. Deposits, payment and ownership

  • A deposit (typically 50%) is payable on acceptance to procure materials and schedule the team.
  • The balance is payable on practical completion, unless agreed milestones state otherwise.
  • Payment terms are strictly 7 days from invoice unless otherwise agreed in writing.
  • Overdue amounts attract interest at the prescribed rate under the Prescribed Rate of Interest Act, 55 of 1975.
  • Ownership of installed materials passes to the client only on full payment.

5. Workmanship and material guarantees

We provide a written workmanship guarantee on every project, the duration of which is specified in the quotation (typically 12 months on general work and up to 10 years on selected waterproofing systems, subject to manufacturer terms). Guarantees exclude:

  • Damage caused by structural movement, third parties or acts of God.
  • Neglected maintenance, alterations by others, or misuse.
  • Pre-existing defects disclosed in writing prior to acceptance.

6. Site access, safety and risk

  • The client must provide safe, reasonable access to the site, water and electricity during working hours.
  • We comply with the Occupational Health and Safety Act 85 of 1993 and maintain public liability insurance.
  • Risk in goods and works passes to the client on installation; we remain responsible for workmanship as per clause 5.

7. Cancellation and cooling-off

Where the CPA applies and the agreement was concluded by direct marketing or electronic transaction, the consumer may cancel without reason within 5 business days of conclusion (CPA s.16 / ECTA s.44), subject to return of any goods supplied and a reasonable charge for services already rendered. After this period, cancellation by the client may attract a reasonable cancellation penalty under s.17 of the CPA covering work performed, materials ordered and lost-time costs.

8. Complaints and dispute resolution

Please raise any concerns in writing to graham.pmc@gmail.com within 7 days so we can investigate and remedy. Unresolved consumer disputes may be referred to the National Consumer Commission or the relevant ombud.

9. Limitation of liability

To the extent permitted by law (and subject to the CPA where it applies), PMC’s total liability arising out of any project is limited to the contract value of that project. We are not liable for indirect, consequential or pure economic loss. Nothing in these terms limits liability for gross negligence, wilful misconduct or any liability that cannot lawfully be excluded.

  • All trade marks, images and copy are owned by or licensed to PMC and may not be reproduced without consent.
  • We are not liable for loss arising from reliance on website content without a written quotation.

11. Personal information

We process personal information in accordance with our Privacy Policy and the Protection of Personal Information Act, 4 of 2013.

12. Governing law and jurisdiction

These terms are governed by the laws of the Republic of South Africa. Disputes are subject to the jurisdiction of the South African courts, and where applicable, the Magistrates’ Court notwithstanding the value of the matter.
